Terms of Service

Welcome to Tonelingo. These Terms of Service ("Terms") are a contract between you and the Tonelingo team ("Tonelingo", "we", "us", or "our"), and they govern your use of tonelingo.app and any related services we offer (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Short version: Tonelingo is a free language-learning tool. We use AI to generate translations and pronunciation, and sometimes the AI is wrong — please don't rely on it for anything critical (medical, legal, professional). Be respectful, don't abuse the Service, and we'll do our best to keep it working.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have the permission of a parent or legal guardian. By using the Service you represent that you meet these requirements.

2. Your account

To use most features of the Service you must create an account using a valid email address. You are responsible for keeping your password confidential and for all activity that occurs under your account. You agree to notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that appear to be shared, automated, or used in violation of these Terms.

3. The Service

Tonelingo helps you learn languages by providing AI-assisted translations, pronunciation audio, saved-vocabulary tools, and related features. The Service is provided on an "as-is" basis and we may add, change, or remove features at any time. We may also set reasonable usage limits (for example, on the number of translations or audio requests per day) to keep the Service available for everyone.

3.1 AI-generated content

Translations, explanations, and audio in the Service are generated by third-party AI models (currently Anthropic's Claude and ElevenLabs). AI output can be wrong, biased, or incomplete. Do not rely on the Service for critical decisions, including legal, medical, financial, safety, or professional communication contexts. Always verify important translations with a qualified human translator.

4. Acceptable use

You agree not to use the Service to:

We may suspend or terminate access, remove content, and take any other action we consider appropriate if you violate these rules.

5. Your content

You keep ownership of the words, phrases, and sentences you submit to the Service ("Your Content"). By submitting Your Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of operating and improving the Service for you. We do not claim ownership of Your Content and we do not use it to train AI models.

You are responsible for Your Content and must have the right to submit it. Do not submit content that is illegal, confidential (e.g., trade secrets you don't have the right to share), or that you do not want a third-party AI provider to process (see our Privacy Policy).

6. Our content

The Service, including its design, code, UI text, and logos, is owned by Tonelingo or its licensors and is protected by copyright, trademark, and other laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the Service for your own language-learning purposes in accordance with these Terms. AI-generated output produced at your request is yours to use, subject to the terms of the relevant AI provider.

7. Third-party services

The Service relies on third-party providers (currently Supabase, Cloudflare, Anthropic, and ElevenLabs). Your use of features powered by those providers is also subject to the providers' own terms. We are not responsible for their services, outages, or actions.

8. Fees

The Service is currently free to use. If we introduce paid features in the future, we will give you notice and the option to accept any additional terms before you are charged.

9. Termination

You may stop using the Service at any time and delete your account by contacting us at support@tonelingo.app. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, if your use creates risk or possible legal exposure for us, or if we choose to discontinue the Service. Sections that by their nature should survive termination (including Sections 4, 5, 10, 11, 12, 13, and 14) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Tonelingo disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated output will be accurate or suitable for your purposes.

11. Limitation of liability

To the maximum extent permitted by law, Tonelingo and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with the Service. Our total aggregate liability to you for all claims arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to liability, or (b) US$50. Some jurisdictions do not allow the limitations above, so those limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold Tonelingo and its operators harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts. Nothing in these Terms prevents you from bringing a claim in small-claims court if you otherwise qualify.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will provide additional notice (for example, by posting a notice in the app or sending an email). Your continued use of the Service after changes become effective means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

15. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Tonelingo concerning the Service. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign these Terms without restriction.
